how did Ignacio Cofone come to write the privacy fallacy?

there's a lot of discourse that judges, lawmakers, etc want to protect our privacy, but in reality we don't get much payoff/protection from harms--just checkboxes, cookies, corporate DP officers

Ignacio Cofone Elettra Bietti Claudia Haupt NUSL CLIC ⚖️ @[email protected] @NUSL tech companies have a huge amount of power not only b/c of the market share that they have, but b/c of the data they have about each of us--data that can be used to determine whether we get credit, a loan, a job, a home, & more.

the privacy fallacy is the contradiction of saying we care about privacy, but then acting like the only thing that matters is protecting negative material consequences like ID theft, wrongful dismissals

if there's something value called privacy, there's more to protect there

My latest paper The Illusion of Inclusion argues that corporate self-regulation and stakeholder engagement can't give us the public sphere that we want. This one got me a job so I am particularly fond of it. Fordham Law Review

It’s cliche at this point to say “data is the new oil” but my brain was screaming it as I read this astoundingly well-reported piece on OpenAI, Google and Meta looking between the internet’s couch cushions and everywhere else to find new training material. nytimes.com/2024/04/06/tec…
