The UK Govt 'chose not to' set aside Art 2 commitments in it's immigration legislation because it could not and cannot do so without breaching the Withdrawal Agreement. NI has a higher baseline of rights protection than other parts of the UK, this has knock on consequences:

Alexander Horne Jonathan Jones NIHRC JRM last week said all asylum seekers should be encouraged to go to NI and then travel on to Dublin. Today's judgment just spells out that they don't have to make the last bit of that journey to benefit from EU law's protection.

The trouble for unionism is that unless the Protocol and Framework are removed completely then they are in a bind—one forced upon them by the UK sovereign parliament. I don’t see that present parliament or likely successor agreeing to the removal process. So, what follows?
