Unfortunately, making a criminal case out of a civil dispute is a rampant legal strategy.

File civil suit. Courts don’t grant you relief sought. Copy paste civil complaint. File FIR. Harass. Déjà Vu.

This move by Supreme Court is welcome / should become case law, but is not

Absolutely correct. Tracking right parameters is the key. Similarly - we also need to look at our GDP (economy) on a per capita basis and not blindly celebrate the tag of 3rd / 4th largest economy. Climbing the charts on per capita income is true measure of development.
